While solicitors focus on the legal content of the dispute, Atherton Bailey partners can help analyse the financial aspects and consequences of the case. This may include reviewing the opposition's arguments and finances.
Our insolvency practitioners can also act as independent expert witnesses and help in the resolution of disputes involved in:
- Arbitrations;
- Tribunals;
- Litigation.
How we work with the legal profession
Our partners offer a free initial consultation to explore the issues and explain how and where we can help. At the meeting we will give you an idea of the likely time to make our recommendations and the hourly rate we will charge. We may also be able to offer a fixed fee.
Solicitors may then appoint one of our experienced insolvency practitioners as a:
- Party appointed expert where you instruct us, but our primary duty is to assist the Court. This duty overrides any obligation to you or your client;
- Single joint expert where we are appointed and instructed by all parties in the dispute with our primary duty to assist the Court. This duty overrides any obligation to any party;
- Expert adviser where our role is to advise only you in the dispute.
The role of the expert witness
As an expert witness we will:
- Report on the relevant issues and evidence and test them against accepted standards;
- Answer questions on our report from all parties;
- Put our report before the court to help it reach a judgement.
